We are asking all residents who can pay their rent to please do so as they normally would. For those residents who cannot pay rent, our commitment remains constant to working collaboratively with you on a case by case basis. As of April 1, we have implemented payment plans designed to give those in need some flexibility around their rent obligation.

Major landlords promise flexibility as COVID-19 eats into tenants' ability to pay rent

Major REITS say they are trying to help, but 80% of rental stock owned by smaller players

Some of Canada's biggest residential landlords say they're committed to working with tenants who have lost their job because of the novel coronavirus pandemic.

The signals come as efforts to contain the outbreak have led to huge business disruptions and surging unemployment that have made many Canadian worried about how they will pay next month's rent.

The speed of the shutdown in many areas of the economy has meant many people will likely be short on next month's rent, especially since government programs meant to help those who have lost their job won't start paying out until April.

The unprecedented times have led some tenants to call for an all-out rent strike, but major rental companies are urging those who are able to pay their rent to do so, while offering assistance to those who find themselves in need.

"If anybody's lost their job, we are there to support them, and there to work with them through the crisis," said Mark Kenney, CEO of Canadian Apartment Properties Real Estate Investment Trust.

"We are violently against evicting people that find themselves in a place of distress right now."

The company, which manages more than 65,000 residential rentals across Canada as well as in Ireland and the Netherlands, says tenants who need to should get in contact with their property manager to explain their situation, offer to pay what they can and discuss ways they might repay the rest over time.

Other major rental companies including Northview Apartment REIT, Greenwin Corp., MetCap Living, and Boardwalk REIT have also issued notices to tenants, asking them to reach out if they are in financial distress and have committed to various degrees of support.

"Right now, our message to our communities is that Greenwin is still here for them. We are committed to working with our residents as much as possible during this difficult time," said Greenwin Corp. CEO Kris Boyce in a statement.

Given the case-by-case nature of these appeals, it's not yet clear just how accomodative the companies will be. Landords are also limited on what immediate action they can take against tenants, since some provinces have suspended eviction tribunals during the crisis.

Kenney at Capreit says the company will be open to both deferring rent until tenants can pay, as well as rent relief in some cases.

He says, however, that he's worried about the roughly 80 per cent of landlords in Canada who are small-scale owners of units and who won't have the same flexibility.

"These are circumstances that we all have to show empathy in and understanding for. But equally, we need to keep the integrity in the system."

The call echoes what has been coming out of Canada Mortgage and Housing Corp., which has asked that people leave both rent and mortage relief to those who need it most while asking those who can to pay their bills.

A Message from the Federation of Rental-Housing Providers of Ontario

TORONTO, March 27, 2020 /CNW/ - Our members sincerely care about our residents. We value you and your families. At this time of emergency, especially, we want you to be safe and secure in your homes. We know that many residents have had their incomes disrupted by the COVID-19 emergency. For some, it may be challenging to pay rent on April 1, 2020.

To take some of the stress out of the situation, we have the following advice on what to do if you cannot pay your rent due to the COVID-19 emergency.

  1. Reach out to your property manager by phone or online (to respect physical distancing).
  2. Explain the situation. 
  3. Offer to pay what you can, if possible. 
  4. Ask about government programs you might qualify for, and for the remainder, discuss a plan for how you could repay over time.

Remember, it is important to please pay your rent if you can. To keep buildings operating, clean, and safe, we need to pay our mortgages, operating costs and employees too.

We understand the situation is unpredictable. Some financial help is already on the way, and all levels of government have already taken steps to help maintain incomes or reduce costs:

  • The Government of Canada has introduced the Canada Emergency Response Benefit which provides $2,000 a month for up to 4 months to individuals who have lost their income as a result of COVID-19. The federal government is also providing a 75% wage subsidy for small and medium-sized businesses so they can keep people employed.
  • The Government of Ontario has set aside $148 million for assistance through Municipal Service Managers, which will use the Canada-Ontario Housing Agreement to direct more resources to tenants. The Province has also committed additional financial relief for low-income seniors, families with children and individuals with student loans.
  • Some municipalities have offered grace periods for municipal payments such as property taxes, water and other utilities, and our members commit to take that into account in making arrangements and calculating arrears. 

We are hopeful that these measures will help benefit our residents, but they may take time to reach those in need. We understand. We urge you to keep the lines of communication open with your property manager.

Privacy Policy

    This Privacy Policy (the "Policy") describes the practices of Canadian Apartment Properties Real Estate Investment Trust and its subsidiaries ("CAPREIT") in relation to the collection, use, disclosure and protection of Personal Information (as defined below). At CAPREIT, we are committed to protecting your privacy through practices that limit the collection, use, disclosure, disposition and destruction of Personal Information to what is necessary for the effective operation of our business. This Policy was created to inform you of our commitment to protecting your Personal Information and is based on the general principles in Schedule 1 of the federal Personal Information Protection and Electronic Documents Act. This Policy also includes information regarding CAPREIT's compliance with Canada's Anti-Spam Legislation (CASL).

    Definition of Personal Information

    Personal Information includes any factual or subjective information about an identifiable individual. Some examples of Personal Information which CAPREIT may collect from you are:

    • Name
    • Gender
    • Age
    • Home address
    • Phone number
    • Email address
    • Family status
    • Social insurance of other ID numbers
    • Income and other Financial Information Personal References
    • Employment information (past and present)

    Purpose for the collection and use of your Personal Information

    CAPREIT collects Personal Information from individuals applying for a lease, and from its tenants and guarantors under lease. CAPREIT uses the Personal Information in connection with the services requested and/or provided, including (i) determining your suitability for a lease and (ii) the ongoing administration of your lease and the obligations thereunder. Examples of the manner in which your Personal Information may be used by CAPREIT include:

    • disclosing such information to any co-tenant or guarantor or to any third party payor of your rent if required under your tenancy agreement or related housing agreement;
    • confirming your income;
    • sharing information with credit reporting agencies to evaluate your credit worthiness in connection with an application to lease;
    • disclosing such information to former and present employers, former and present landlords, personal references, and present banking institution, all of whom are named by you in documents submitted to us so that we may contact them as part of the process of evaluating your lease application;
    • contacting you should matters relevant to your tenancy arise;
    • contacting you regarding the administration of the lease or the tenancy;
    • enforcing the terms of your tenancy agreement, including collection of any judgment that may be obtained against you as a consequence of breach of the agreement;
    • disclosing such information to one or more providers of any security alarm system, cable television, telephone, telecommunication, hydro-electricity, water/hot water, gas and/or other similar or related services to you and who are restricted from using your personal information other than for the purpose of contacting you for the provision of such services, and all of whom are disclosed on Schedule "A" of this Policy from time to time;
    • disclosing such information to Canada Customs & Revenue Agency, to whose attention the T-5 interest income tax information return and/or the NR4 non-resident withholding tax information return is submitted (where applicable), which will contain or refer to my social insurance number as required by Regulations to the Income Tax Act (Canada); and
    • disclosing such information to third parties who may have access to such personal information incidentally through their administration and servicing of software used by us in our business operations;
    • processing employment applications and other employment-related matters, such as paycheques, tax receipts and tax filings, disclosing information to an insurance company for the purpose of providing health benefits, or, in the case of contract workers or prior applicants for employment, contacting them for further work;
    • disclosing to third parties in connection with a disposition of your building, an assignment of your lease agreement, obtaining financing or otherwise as required or permitted by law;
    • and disclosing such information to any additional person or business entity, where you further consent to such disclosure.

    Consenting to our collection, use and disclosure of your Personal Information

    The collection, use or disclosure of your Personal Information by CAPREIT requires your knowledge and consent. At certain times, your consent for the collection, use and disclosure of your Personal Information may be implied from the manner in which it is collected. For example, when you provide us with your Personal Information in connection with a lease, you have implicitly consented to CAPREIT collecting, utilizing and disclosing your Personal Information in a manner necessary to determine your suitability for, and administer, your lease as further described in the paragraph above. Your consent may also be expressly provided by you. If CAPREIT collects, uses or discloses Personal Information for purposes other than those described above, prior to the collection, use and/or disclosure of such Personal Information, unless required to be disclosed by law, you will be informed of, and your consent obtained prior to, CAPREIT's collection, use and/or disclosure of that Personal Information. If we intend to use and/or disclose Personal Information that we previously collected for a new purpose which is not authorized under applicable laws, your consent will always be obtained before we use and/or disclose it for that new purpose.

    You may always choose not to supply CAPREIT with your Personal Information. Furthermore, previously granted consent may be withdrawn at any time by notifying the Chief Privacy Officer in writing.

    Collection, Use and Disclosure of Personal Information Without Consent

    There are certain circumstances where we may, or may be required to, collect, use or disclose your Personal Information without your knowledge or consent. Those circumstances include: if the disclosure is required by law, provided to our lawyers, for the purpose of collecting a debt you owe to us, in compliance with a subpoena, warrant, or issued order made by a court, person or body with jurisdiction to compel the production of information, or to comply with rules of court relating to the production of records.

    Disclosure may also be made to a government institution or investigative body that has made a request for the information, identified its lawful authority to obtain the information and indicated that: it suspects that the information relates to national security, the defence of Canada or the conduct of international affairs, the disclosure is requested for the purpose of carrying out any investigation relating to the enforcement, gathering intelligence for the purpose of enforcing, or enforcing any law of any jurisdiction, or the disclosure is requested for the purpose of administering any law of Canada or a province. Disclosure may be made to an investigative body if the disclosure is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.

    Various government agencies (e.g., Canada Revenue Agency, Information and Privacy Commissioner, Human Rights Commission, etc.) have the authority to review our files and interview our staff as a part of their mandates. Also, upon our initiative, we may also disclose Personal Information without your knowledge or consent if the information is used for the purpose of acting in respect of an emergency that threatens the life, health, or security of an individual, or has been collected under circumstances in which consent is not required. If information regarding an identifiable individual is disclosed to a person who needs the information because of an emergency that threatens the life, health or security of an individual and, if the individual whom the information is about is alive, we will inform that individual in writing of the disclosure without delay.

    Amount of Personal Information collected by CAPREIT

    The amount of Personal Information collected by CAPREIT shall be limited to what is necessary for the identified purpose of that collection.

    Retention of your Personal Information

    CAPREIT will retain your Personal Information for as long as it is necessary to fulfill the purpose for which it was collected and to comply with applicable laws. After the Personal Information is no longer necessary either for the purpose for which it was collected or to comply with any laws it will be destroyed, erased, or made anonymous.

    Protection of your Personal Information

    CAPREIT will protect your Personal Information in a manner that is consistent with and appropriate to the sensitivity of that Personal Information. Our handling of your Personal Information will respect its confidential nature at all times from the time of its collection until its ultimate disposal or destruction.

    A complete list of persons or business entities to whom your personal information may be provided and who may, in turn, send Commercial Electronic Messages (CEMs) to you is attached as a schedule to this privacy policy under the heading: "Third Party Disclosure". At this time, we have taken steps to generally prohibit third parties from using your personal information for the purpose of sending you CEMs unless same are exempt from restrictions of, or are otherwise sent in full compliance with, Canada's Anti-Spam Legislation (CASL).

    As a service and convenience for tenants we may maintain public directories of tenants (e.g., by the front door). If you do not wish to be listed in any directories or wish to be described in a particular way, please let us know.

    CAPREIT undertakes to use reasonable efforts to maintain the accuracy, completeness and currency of your Personal Information that is held by CAPREIT as is necessary to fulfill the purpose for which it was collected and is to be used. We may from time to time ask you to confirm the accuracy of your Personal Information for such purpose.

    Use of Video Surveillance and Recordings

    Video equipment may be installed and operating in common areas of our buildings in which your rental unit is located. The video equipment may have capabilities such as zoom, or night-vision features. The video equipment may be operating at all times. Surveillance of the video recordings may occur at any time. 

    The purpose this equipment is to ensure your safety, security and reasonable enjoyment and that of the other tenants, to ensure you have access to the premises, equipment and services that CAPREIT has agreed to provide, to preserve our CAPREIT's property, and to deter crime.

    Where required by law, signs will be posted informing you that video equipment is operating and recording personal information about you. You can contact our Privacy Officer if you have questions regarding the video recordings.

    Use of Audio Equipment and Recordings

    There are circumstances under which CAPREIT may make audio recordings of its employees, contractors, or tenants. There are several purposes for making the recordings; they include: situations where there are work-related performance issues in respect of CAPREIT's role as employer, to ensure the safety of the workplace, to ensure productivity, and to prevent harassment.

    Audio recordings may be made during meetings, interviews, or telephone calls between the CAPREIT and its employees. Audio equipment may be operating at other times. Information recorded by the audio equipment may capture communications of any of the following persons: the employer, employee, tenants, contractors, and the general public.

    Accessing your Personal Information

    Access to your Personal Information held by CAPREIT may be requested by contacting the Chief Privacy Officer in writing. Upon such written request, you shall, to the extent possible and/or where permitted under applicable law: (a) be informed of the existence, use and disclosure of your Personal Information and (b) be given access to that Personal Information. Any questions with regard to requesting access to Personal Information may be addressed to the Chief Privacy Officer. 

    Changes to our Privacy Policy

    CAPREIT reserves the right to change this Privacy Policy from time to time. If we make a material change, this Privacy Policy will be updated accordingly. We recommend that you periodically review this Privacy Policy, which is available in our site office and on our website www.capreit.net, so that you are aware of any changes. Your continued reading of the policy and use of our site following the posting of any changes to this Privacy Policy shall constitute your acceptance of these changes.
